1. Definitions
- The Company: FASTPARK LTD, company number 07794305, registered office 1st Floor 4, Longwalk Road, Stockley Park, Uxbridge, England, UB11 1FE.
- The Customer: the person named in the booking documents.
- The Compound: the Company's premises, or any new or temporary premises used from time to time.
- The Driver: the Company representative who meets the Customer at the airport and drives the vehicle to and from the Compound.
- The Vehicle: the vehicle received into the Compound, including any car, 4x4, MPV or other mechanical device on wheels or tracks, its equipment and accessories.
2. Basis of contract
A contract exists only where the Customer has received written acknowledgement of the booking from the Company and payment has been made.
3. Security
The Company makes strenuous efforts to ensure the Compound is secure and that the Vehicle is driven safely to and from the airport and between sites. The primary compound is four miles from the airport. During peak periods the Vehicle may be moved to a secondary compound a further four miles away.
4. The Company's liability
This clause must be reconciled with the customer-facing handover copy. It currently says vehicles are received unchecked, while the website describes a condition record made with the customer. One of the two has to change.
The Company is not responsible for ascertaining the physical or mechanical condition of the Vehicle. Should an accident occur on the public highway while driven by a Company employee, it will be handled by the Company's insurers. All vehicles are parked on the owner's insurance.
The Company, its employees and agents:
- Accept liability for loss, theft, mis-delivery, temporary failure to deliver or damage to the Vehicle or its contents only where proved to be caused by the Company's negligence, wilful act, default or breach of statutory duty, and only if reported before the Vehicle is driven away from the airport.
- Accept liability for defects rendering the Vehicle unusable where proved to be caused by the Company's negligence. A temporary vehicle up to a small people carrier may be provided if the Customer arranges fully comprehensive insurance for it.
- Where liability is accepted, will arrange remedial work through the Company's chosen repairer.
- Cannot accept liability for damage arising from acts of nature at the Compound, nor for windscreens or other glass unless caused by the Company's negligence.
- Do not accept responsibility for mechanical or electrical failure, or punctured tyres, unless caused by the Company's negligence, wilful default or breach of statutory duty.
- Accept liability for death, personal injury or loss of personal belongings only where proved to be caused by the Company's negligence, wilful default or breach of statutory duty.
- Due to time constraints, low lighting and weather, not all existing marks and scratches may be recorded at handover.
5. Complaints and claims
Check the Vehicle before you leave the airport and tell the Driver immediately about any damage or loss. Claims cannot be considered once the Vehicle has left the airport. In cases of theft, inform the Police and your insurers. Close all windows and remove valuables before handover; the Company cannot accept responsibility for valuables left in the Vehicle.
Explain the practical claims process in plain English before the customer drives away, and make sure the same explanation appears in the FAQs.
6. Time of arrival
Allow enough time to meet the Driver. The Driver will wait 45 minutes after the agreed meeting time unless told otherwise by telephone.
7. Charges
The Customer agrees to pay all charges due promptly. Every person contracting with the Company does so on behalf of themselves and all others with an interest in the Vehicle.
8. Cancellations
One approved cancellation clause: how to cancel, any cut-off, how refunds are issued and how long they take. It must match the booking platform's behaviour, the FAQs, the checkout summary and the confirmation email.
9. General
The Vehicle must be roadworthy, taxed and hold a current MOT where applicable. The Company may move the Vehicle within or outside the Compound and on the public highway as necessary for the efficient operation of its facilities.
10. Variation
No person has authority to vary these terms unless in writing under the hand of the Company Secretary or a Director of the Company.
